Worth knowing Most of the Florida Digital Bill of Rights applies only to companies with over $1 billion in global revenue, but § 501.715 applies to any for-profit business in Florida that collects personal data and sells sensitive data, which must get prior consent and post the notice "NOTICE: This website may sell your sensitive personal data."

Florida does not have a broadly applicable comprehensive privacy law. The Florida Digital Bill of Rights is a comprehensive-style law, but its main controller duties apply only to for-profit businesses that do business in Florida, make more than $1 billion in global gross annual revenue, and either derive 50 percent or more of revenue from online advertising, operate a consumer smart speaker and voice command service, or operate an app store with at least 250,000 applications (Section 501.702(9)). One provision, the sensitive-data sale rule in Section 501.715, applies to any for-profit business that does business in Florida and collects personal data.

What the website needs
  • A covered controller must provide a reasonably accessible and clear privacy notice, updated at least annually, listing the categories of personal data processed, the purpose, how to exercise and appeal rights, the categories of data shared with third parties and of those third parties, and the methods for submitting requests (Section 501.711(1)).
  • A covered controller must provide a mechanism on its website for consumers to submit requests (Section 501.709(3)).
  • A covered controller that sells personal data or processes it for targeted advertising must clearly and conspicuously disclose that processing and how to opt out (Section 501.711(4)).

What a Florida brokerage site must show

All Florida real estate advertisements must include the licensed name of the brokerage firm and must be presented so that reasonable people know they are dealing with a real estate licensee. On an internet site, the brokerage firm name must be placed adjacent to, or immediately above or below, the point of contact information.

What the website needs
  • Under F.A.C. 61J2-10.025(1), all real estate advertisements must include the licensed name of the brokerage firm, and no advertisement may be fraudulent, false, deceptive or misleading.
  • Under F.A.C. 61J2-10.025(2), when a licensee's personal name appears in an advertisement, at least the licensee's last name must be used as it is registered with the Commission.
  • Under F.A.C. 61J2-10.025(3)(a), when advertising on a site on the Internet, the brokerage firm name must be placed adjacent to or immediately above or below the point of contact information, which includes mailing and street addresses, email addresses, and telephone or fax numbers for the firm or licensee.
  • Under F.A.C. 61J2-10.026(4), team or group names may include the word "team" or "group" but may not include words such as Agency, Associates, Brokerage, Brokers, Company, Corporation, Corp., Inc., LLC, LP, LLP, Partnership, Properties, Property, Real Estate or Realty, or similar words suggesting a separate brokerage or company.
  • Under F.A.C. 61J2-10.026(6), in advertisements containing a team or group name, the team or group name may not be in larger print than the name of the registered brokerage, and the advertising must make clear that the public is dealing with a team or group.

Accessibility

The federal ADA

Title III of the ADA covers businesses open to the public, but the Department of Justice has no regulation that sets a technical standard for private business websites. DOJ's web guidance says businesses have flexibility in how they make their websites accessible and points to WCAG as a helpful existing technical standard. Federal appeals courts have not agreed on when a website is covered, so a website's legal status can depend on where a lawsuit is filed and whether the site is connected to a physical location. Florida has no separate website accessibility statute for private businesses in our research, so WCAG 2.2 AA is the practical target.

What the website needs
  • For public agencies only: Accessibility of state agency information technology. Florida state agencies must make the electronic and information technology they acquire on or after July 1, 2006, accessible under Section 508 of the federal Rehabilitation Act, unless doing so would impose an undue burden, in which case they must provide the information through an alternative method.
