Privacy

Indiana Consumer Data Protection Act

Ind. Code 24-15 · in effect since January 1, 2026 Source

The law applies to persons that conduct business in Indiana or produce products or services targeted to Indiana residents and that, during a calendar year, control or process personal data of at least 100,000 Indiana consumers. It also applies to persons that control or process personal data of at least 25,000 Indiana consumers and derive more than 50 percent of gross revenue from the sale of personal data. Government bodies, financial institutions and data subject to the Gramm-Leach-Bliley Act, HIPAA covered entities and business associates, nonprofit organizations, institutions of higher education, public utilities, and certain insurance-fraud organizations are exempt.

What the website needs
  • A covered controller must provide a reasonably accessible, clear, and meaningful privacy notice that lists the categories of personal data processed, the purpose of processing, how consumers can exercise their rights and appeal a decision, the categories of personal data shared with third parties, and the categories of third parties with whom personal data is shared.
  • A controller that sells personal data or uses it for targeted advertising must clearly and conspicuously disclose that activity and how a consumer can opt out.
  • A controller must establish one or more secure and reliable means for consumers to submit requests, must describe them in the privacy notice, and may not require a consumer to create a new account.
  • A controller may not process sensitive data without the consumer's consent, and sensitive data about a known child must be processed under the federal Children's Online Privacy Protection Act.

What an Indiana brokerage site must show

Indiana requires any display, classified advertising, signs, Internet advertising, or business cards that carry a broker's name to contain the clearly visible name of the broker company with which the broker is associated. All advertising must be under the direct supervision and in the name of the broker company.

What the website needs
  • Internet advertising that carries the name of a broker associated with a broker company must carry the broker company's name, either as it appears on the company's license or by its publicly known name (876 IAC 8-1-8(c)).
  • In electronic displays of limited information, such as thumbnails, text messages, and tweets, the broker company's name may be omitted if the display links to a display that includes the broker company's name (876 IAC 8-1-8(c)).
  • Advertising by a broker company must reveal the company's name as it appears on its license or by its publicly known name (876 IAC 8-1-8(b)).
  • Advertising in which only a post office box number, telephone number, or street address appears may not be used (876 IAC 8-1-8(e)).
  • A broker may not advertise in a manner indicating that the property is offered by a private party not engaged in the real estate business (876 IAC 8-1-8(d)).

Title III of the ADA covers businesses open to the public, but the Department of Justice has no regulation that sets a technical standard for private business websites. DOJ's web guidance says businesses have flexibility in how they make their websites accessible and points to WCAG as a helpful existing technical standard. Federal appeals courts have not agreed on when a website is covered, so a website's legal status can depend on where a lawsuit is filed and whether the site is connected to a physical location. Indiana has no separate website accessibility statute for private businesses in our research, so WCAG 2.2 AA is the practical target.
