Builders in the Salt Lake City metro were authorized to build 4,563 new housing units from January through August 2026, 2% more than the 4,462 in the same months of 2025.

53% of those units are in buildings with five or more homes, against 32% nationally.

Worth knowing Utah SB 68 (2026), effective May 6, 2026, lets a Utah business sued over website accessibility ask a court to find the suit abusive, with a presumption in its favor if it tries in good faith to fix the problem within 30 days, or fixes it within 90 days, after detailed written notice.

Privacy

Utah Consumer Privacy Act

Utah Code Ann. § 13-61-101 et seq. · in effect since December 31, 2023 Source

The law applies only to a controller or processor that conducts business in Utah or targets products or services to Utah residents, has annual revenue of $25,000,000 or more, and either controls or processes personal data of 100,000 or more consumers during a calendar year or derives over 50 percent of gross revenue from the sale of personal data while controlling or processing personal data of 25,000 or more consumers. It does not apply to governmental entities, tribes, institutions of higher education, nonprofit corporations, HIPAA covered entities, or business associates.

What the website needs
  • A covered controller must provide a reasonably accessible and clear privacy notice that lists the categories of personal data processed, the purposes of processing, how consumers may exercise a right, the categories of personal data shared with third parties, and the categories of third parties with whom personal data is shared.
  • A controller that sells personal data or engages in targeted advertising must clearly and conspicuously disclose how a consumer can opt out of the sale or of processing for targeted advertising.
  • A controller may not process sensitive data without first giving the consumer clear notice and an opportunity to opt out, which is an opt-out standard rather than the opt-in consent used in most other states; data about a known child must be processed under the federal Children's Online Privacy Protection Act.
  • Consumers may confirm and access their data, delete data they provided, obtain a portable copy, and opt out of targeted advertising and the sale of personal data, and the right to correct inaccuracies is added effective July 1, 2026.

What an Utah brokerage site must show

A Utah licensee may not advertise real estate services or property in any medium, including the internet, without clearly and conspicuously identifying the name of the brokerage with which the licensee is affiliated, using the brokerage name shown on Division records. When showing the brokerage name in an electronic advertisement is not reasonable, the advertisement must link directly to a display that clearly and conspicuously identifies the brokerage.

What the website needs
  • Under Utah Admin. Code R162-2f-102(2), "advertising" means a commercial message through media that include the Internet, email and other electronic communication.
  • Under R162-2f-401h(1), a licensee may not advertise, or permit anyone employed by or affiliated with the licensee to advertise, real estate services or property in any medium without clearly and conspicuously identifying the name of the brokerage with which the licensee is affiliated.
  • Under R162-2f-401h(4), the brokerage name in an advertisement must be the name of the brokerage as shown on Division records.
  • Under R162-2f-401h(2), when it is not reasonable to identify the brokerage name in an electronic advertisement, the advertisement must link directly to a display that clearly and conspicuously identifies the brokerage name.
  • Under R162-2f-401h(5), a team, group, or other marketing entity that includes one or more licensees is subject to the same advertising requirements and restrictions as an individual licensee.

SB 68 lets a Utah resident or business sued over ADA website accessibility, or the attorney general on its behalf, ask a court to decide whether the lawsuit is abusive, meaning its primary purpose is to obtain payment rather than fix the website. A lawsuit is presumed abusive if the defendant tried in good faith to fix the problem within 30 days, or fixed it within 90 days, after detailed written notice, and a court may award fees, costs, punitive damages, and sanctions. The enrolled bill took effect May 6, 2026, and the provisions are scheduled for repeal on July 1, 2031.
