Privacy

Colorado Privacy Act (CPA)

C.R.S. § 6-1-1301 et seq.; Colorado Privacy Act Rules, 4 CCR 904-3 · in effect since July 1, 2023 Source

The CPA applies to a controller that conducts business in Colorado or produces or delivers commercial products or services intentionally targeted to Colorado residents and that either controls or processes the personal data of 100,000 or more consumers in a calendar year, or derives revenue or receives a discount from selling personal data and processes or controls the personal data of 25,000 or more consumers. A controller that processes any amount of biometric identifiers or biometric data is covered for that data regardless of volume. The minors' protections in §§ 6-1-1305.5, 6-1-1308.5 and 6-1-1309.5 apply to any controller doing business in Colorado regardless of volume or revenue. Nonprofits are covered.

What the website needs
  • A controller must provide a reasonably accessible, clear and meaningful privacy notice listing the categories of personal data collected or processed, the purposes, how consumers can exercise their rights and appeal a decision with the controller's contact information, the categories of personal data shared with third parties, and the categories of those third parties (C.R.S. § 6-1-1308(1)(a)).
  • A controller that sells personal data or uses it for targeted advertising must clearly and conspicuously disclose that processing and how to opt out (C.R.S. § 6-1-1308(1)(b)).
  • The opt-out method must appear clearly and conspicuously in the privacy notice and in a clear, conspicuous and readily accessible location outside the privacy notice (C.R.S. § 6-1-1306(1)(a)(III)).
  • A controller may not process sensitive data without first obtaining the consumer's consent, and for a known child it must obtain a parent's or guardian's consent (C.R.S. § 6-1-1308(7)).

What a Colorado brokerage site must show

All Colorado real estate advertising must be done clearly and conspicuously in the name of the broker's brokerage firm, and the rules define advertising to include websites and social media. When a broker owns or controls electronic media, each viewable page must include the brokerage firm's name.

What the website needs
  • Under 4 CCR 725-1, Rule 6.10.A.4, all advertising must be done clearly and conspicuously in the name of the broker's brokerage firm; a broker advertising their own property that is not listed with their firm is exempt.
  • Under Rule 1.2, advertising includes business cards, brochures, websites, signage, property flyers, mailings, social media, letterhead, email signatures and contract documents, while a URL or email address alone is not advertising unless it is used directly to promote brokerage services.
  • Under Rule 6.10.D.1, when a broker owns or controls electronic media, each viewable page must include the broker's brokerage firm name, and expired listings must be removed within three days after a listing contract expires; Rule 1.62 defines a viewable page to include pages that scroll and frame pages.
  • Under Rule 6.10.D.4, when space in an electronic medium is too limited to show the brokerage firm name, the name must be disclosed clearly and conspicuously within the first click.
  • Under Rule 6.10.D.3, brokers who advertise through email, chat, instant messages, discussion lists, bulletin boards, blogs or similar means must use the brokerage firm name, but need not repeat it to a consumer who has already received it.

Accessibility

The federal ADA

ADA Title III Source

Title III of the ADA covers businesses open to the public, but the Department of Justice has no regulation that sets a technical standard for private business websites. DOJ's web guidance says businesses have flexibility in how they make their websites accessible and points to WCAG as a helpful existing technical standard. Federal appeals courts have not agreed on when a website is covered, so a website's legal status can depend on where a lawsuit is filed and whether the site is connected to a physical location. Colorado has no separate website accessibility statute for private businesses in our research, so WCAG 2.2 AA is the practical target.

What the website needs
  • For public agencies only: HB21-1110, digital accessibility for state and local government. HB21-1110 made it disability discrimination for a Colorado public entity or state agency to fail to fully comply, on or before July 1, 2024, with the accessibility standards set by the Office of Information Technology. A person with a disability may sue and may obtain remedies that include a statutory fine of $3,500 payable to each plaintiff for each violation.
  • For public agencies only: HB24-1454, one-year good-faith grace period. HB24-1454 made a public entity or state agency immune from liability until July 1, 2025, if it showed good-faith efforts toward compliance, including a progress report on its website updated quarterly and a clear process for requesting redress. The grace period provision repealed itself on July 1, 2025, so it no longer applies.
