Privacy

Oklahoma consumer data privacy act (SB 546, 2026)

SB 546 (2025-2026), approved March 20, 2026; to be codified at 75A O.S. Sections 300 through 320 unless the numbering duplicates another section. · takes effect January 1, 2027 Source

The act applies to a controller or processor that conducts business in Oklahoma or produces a product or service targeted to Oklahoma residents and that, during a calendar year, controls or processes personal data of at least 100,000 consumers, or controls or processes personal data of at least 25,000 consumers and derives over 50 percent of gross revenue from the sale of personal data. It does not apply to state agencies and political subdivisions, financial institutions or data subject to Title V of the Gramm-Leach-Bliley Act, HIPAA covered entities and business associates, nonprofit organizations, or institutions of higher education. Governor Kevin Stitt approved the bill on March 20, 2026, and it takes effect January 1, 2027.

What the website needs
  • A covered controller must provide a reasonably accessible and clear privacy notice that lists the categories of personal data processed (including any sensitive data), the purpose of processing, how consumers can exercise their rights and appeal a decision, and, if applicable, the categories of personal data shared with third parties and the categories of those third parties (Section 8).
  • A controller that sells personal data or processes it for targeted advertising must clearly and conspicuously disclose that processing in the privacy notice, along with how a consumer can opt out (Section 8(B)).
  • A controller must offer two or more secure and reliable methods for consumers to submit rights requests and may not require a consumer to create a new account (Section 6).
  • A controller that maintains a website must provide a mechanism on the website for consumers to submit requests; a controller that operates exclusively online and has a direct relationship with the consumer only has to provide an email address (Section 6(C) and (D)).

Real estate advertising

What an Oklahoma brokerage site must show

Oklahoma brokers must advertise under their registered trade name or licensed name and show that they are real estate brokers, and associates and teams must include the broker's reference in a size at least 50 percent of any associate or team reference. On an associate's or team's website, the broker's reference must appear on every individual page or frame.

What the website needs
  • A broker must advertise under the registered business trade name or the name under which the broker is licensed, and the advertisement must indicate that the party is a real estate broker and not a private party, using terms such as 'agency', 'company', 'realty', or 'real estate' (OAC 605:10-9-4(a)(1)).
  • No real estate advertisement may show only a post office box number, telephone number, or street address (OAC 605:10-9-4(a)(2)).
  • An associate may not advertise only under the associate's name, and all associate advertising must include the broker's name or trade name so that the broker's reference is 'prominent, conspicuous and easily identifiable', meaning at least 50 percent or larger than any associate reference (OAC 605:10-9-4(b)(1) and (b)(3)).
  • With broker approval, an associate may use a domain or website name that is registered with the broker, and within that domain or website the broker's reference must appear on every individual page and/or frame (OAC 605:10-9-4(b)(3)(E)).
  • A team may not advertise only under the team name, all team advertising must be supervised by the team's broker, and the broker's reference must be at least 50 percent or larger than any team reference (OAC 605:10-9-4(c)(1)-(3)).

Title III of the ADA covers businesses open to the public, but the Department of Justice has no regulation that sets a technical standard for private business websites. DOJ's web guidance says businesses have flexibility in how they make their websites accessible and points to WCAG as a helpful existing technical standard. Federal appeals courts have not agreed on when a website is covered, so a website's legal status can depend on where a lawsuit is filed and whether the site is connected to a physical location. Oklahoma has no separate website accessibility statute for private businesses in our research, so WCAG 2.2 AA is the practical target.
