Privacy

Alabama Personal Data Protection Act

HB 351, 2026 Regular Session (enrolled); the Act number and Code of Alabama section were not confirmed. · takes effect May 1, 2027 Source

The act applies to persons that conduct business in Alabama or produce products or services targeted to Alabama residents and that either control or process the personal data of more than 25,000 consumers (excluding data processed solely to complete a payment transaction) or derive more than 25 percent of gross revenue from the sale of personal data. It exempts, among others, businesses with fewer than 500 employees that do not sell personal data, nonprofit entities with fewer than 100 employees that do not sell personal data, political subdivisions, higher education institutions, Gramm-Leach-Bliley financial institutions, and HIPAA covered entities and business associates. Law-firm reports say Governor Kay Ivey signed it in April 2026, and Section 12 makes it effective May 1, 2027.

What the website needs
  • A controller must let consumers opt out through a clear and conspicuous link on its website to a page that lets them opt out of targeted advertising or the sale of personal data, or that gives current contact information for submitting the opt-out request (Section 6(b)).
  • A controller must provide a reasonably accurate, clear, and meaningful privacy notice listing the categories of personal data processed, the purpose of processing, the categories of personal data shared with third parties, the categories of third parties, an active email address or other contact mechanism, and how consumers can exercise their rights, including a link or contact information for the opt-out method (Section 7(d)).
  • A controller must describe in its privacy notice one or more secure and reliable means for submitting rights requests and may not require a consumer to create a new account (Section 7(e)).
  • A controller that sells personal data or processes it for targeted advertising must clearly and conspicuously disclose that processing and how to opt out (Section 7(c)).

What an Alabama brokerage site must show

An Alabama salesperson or associate broker may not advertise as a real estate agent unless the name or trade name of the qualifying broker or company appears prominently, which the statute defines as a font size equal to or larger than any other name, text or logo in the advertisement (other than terms like "for sale" or "for lease"), placed and sized to gain consumers' attention. Team advertising must also follow Ala. Code § 34-27-39 and Rule 790-X-3-.16.

What the website needs
  • Under Ala. Code § 34-27-36(b)(15), as amended by Act 2025-380 effective October 1, 2025, a salesperson or associate broker may not advertise as a real estate agent without the name or trade name of the qualifying broker or company under whom he or she is licensed appearing prominently, and a qualifying broker or company may not allow such advertising.
  • Under § 34-27-36(b)(15), "prominently" means using a font size that is equal to or larger than any other name, text, or logo in the advertisement, other than terms like "for sale" or "for lease," and situated and sized for the purpose of gaining the attention of consumers viewing the advertisement.
  • Under § 34-27-39(e), a licensee who advertises as part of a team must include the name of at least one team member and the name of the company with which the licensee is licensed, must include the term "team" or "group" in the team name, and must have written authorization from the qualifying broker to include the team name in the advertisement.
  • Under Ala. Admin. Code r. 790-X-3-.16 (Advertising Teams), effective February 14, 2026, a team name must include the word "team" or "group" and may not use terms suggesting the team is a real estate company, including the words and abbreviations for "corporation," "limited liability company," "partnership," "business," "enterprise," and "company."
  • The earlier Rule 790-X-3-.16 (Advertising), which defined "prominently" by rule, was repealed and replaced effective February 14, 2026, and the definition now appears in the statute.

Title III of the ADA covers businesses open to the public, but the Department of Justice has no regulation that sets a technical standard for private business websites. DOJ's web guidance says businesses have flexibility in how they make their websites accessible and points to WCAG as a helpful existing technical standard. Federal appeals courts have not agreed on when a website is covered, so a website's legal status can depend on where a lawsuit is filed and whether the site is connected to a physical location. Alabama has no separate website accessibility statute for private businesses in our research, so WCAG 2.2 AA is the practical target.
