Building activity

WHAT’S BEING
built.

New buildings mean new properties to lease and new businesses to open. Census Building Permits Survey, August 2026.

Builders in the Lincoln metro were authorized to build 1,326 new housing units from January through August 2026, 18% fewer than the 1,620 in the same months of 2025.

42% of those units are in buildings with five or more homes, against 32% nationally.

That is an apartment-heavy pipeline. Each new community needs a leasing website, usually before construction finishes, and the developer often needs a project site for investors and the city as well.

What this means for your site

Lincoln.

What we would plan into a Lincoln website, based on the numbers above.

Talk through your site
  1. 01

    Show the deals

Brokerages are 1.33 times as concentrated here as nationally. A brokerage site stands out with closed deals, current listings that stay up to date, and a page for each broker.

  2. 02

Rentals one tap from the homepage

39% of households here rent, against 35% nationally. Property management and apartment sites should put available rentals, the application, and the resident portal at the top of the homepage on phones.

  3. 03

    Launch before the building opens

42% of new homes permitted this year are in buildings of five or more units. Pre-leasing websites need to be live months before the first move-in.

  4. 04

    Privacy notice and opt-outs

The Nebraska Data Privacy Act applies to many businesses that collect visitors’ details in Nebraska. A covered site needs a current privacy notice and working opt-out links, and it must honor browser opt-out signals such as Global Privacy Control.

  5. 05

    Accessible by default

Every site we build follows WCAG 2.2 AA practice: readable contrast, keyboard navigation, labeled forms, and text alternatives for images. Federal ADA website lawsuits run into the thousands each year, most of them filed in New York, Florida, and Illinois.

Nebraska rules

WHAT THE LAW
asks of your site.

State rules that change what goes on a business or real estate website in Nebraska, checked against official sources as of October 9, 2026. This is general information, not legal advice; your counsel owns the final wording.

Privacy

Nebraska Data Privacy Act

Neb. Rev. Stat. Sections 87-1101 to 87-1130. · in effect since January 1, 2025 Source

The act applies to a person that conducts business in Nebraska or produces a product or service consumed by Nebraska residents, processes or sells personal data, and is not a small business as determined under the federal Small Business Act. A small business is still barred from selling a consumer's sensitive data without prior consent (Section 87-1118). It does not apply to state agencies, Gramm-Leach-Bliley financial institutions, HIPAA covered entities, nonprofit organizations, institutions of higher education, and certain utilities. The Governor approved LB1074 on April 17, 2024, and its privacy sections became operative on January 1, 2025.

What the website needs
  • A controller must provide a reasonably accessible and clear privacy notice listing the categories of personal data processed (including sensitive data), the purpose of processing, how to exercise rights and appeal, the categories of data shared with third parties and the categories of those third parties, and the methods for submitting requests (Section 87-1113).
  • A controller that sells personal data or processes it for targeted advertising must clearly and conspicuously disclose that processing and how to opt out (Section 87-1114).
  • A controller must offer two or more secure methods for rights requests and must provide a request mechanism on its website if it maintains one; an exclusively online controller with a direct consumer relationship only has to provide an email address (Section 87-1111).
  • A controller must obtain consent before processing sensitive data (Section 87-1112).

Accessibility

The federal ADA

ADA Title III Source

Title III of the ADA covers businesses open to the public, but the Department of Justice has no regulation that sets a technical standard for private business websites. DOJ's web guidance says businesses have flexibility in how they make their websites accessible and points to WCAG as a helpful existing technical standard. Federal appeals courts have not agreed on when a website is covered, so a website's legal status can depend on where a lawsuit is filed and whether the site is connected to a physical location. Nebraska has no separate website accessibility statute for private businesses in our research, so WCAG 2.2 AA is the practical target.

We own ten homes at Casa De Laguna and were still sending people to a site built in 2013. Noah pulled the photos and details out of the old site, designed a logo from the rooflines and the pond, and put the community, the homes and current availability in one place. It’s the first time the website has looked like the place we actually rent.
