    California privacy rules

    California’s CCPA, as amended by the CPRA, applies to larger businesses and those that buy, sell, or share personal information, and CalOPPA requires a privacy policy on any commercial site that collects personal information from Californians. We build the notice and opt-out links into the site.

    Accessible by default

    Every site we build follows WCAG 2.2 AA practice. In California, the Unruh Civil Rights Act sets damages of at least $4,000 per violation for accessibility claims, so it matters more here than in most states.

WHAT THE LAW
asks of your site.

State rules that change what goes on a business or real estate website in California, checked against official sources as of October 9, 2026. This is general information, not legal advice; your counsel owns the final wording.

Worth knowing California's Online Privacy Protection Act requires a posted privacy policy on any commercial website that collects personally identifiable information from California residents, with no revenue threshold, while the CCPA applies only to businesses that meet one of its three thresholds.

The CCPA applies to a for-profit business that collects California consumers' personal information, does business in California, and meets at least one threshold. The first threshold is annual gross revenue above $25,000,000 in the preceding calendar year as adjusted for inflation, which the California Privacy Protection Agency set at $26,625,000 effective January 1, 2025. The second is buying, selling, or sharing the personal information of 100,000 or more consumers or households a year. The third is deriving 50 percent or more of annual revenue from selling or sharing consumers' personal information.

What the website needs
  • A covered business must give a notice at or before the point of collection that lists the categories of personal information collected, the purposes, whether the information is sold or shared, and how long each category will be kept (Civ. Code § 1798.100(a)).
  • The online privacy policy must describe consumer rights, list at least two methods for submitting requests, list the categories of personal information collected, sold or shared, and disclosed in the preceding 12 months, and be updated at least once every 12 months (Civ. Code § 1798.130(a)(5)).
  • Under the regulations, the privacy policy must be reachable through a conspicuous link using the word 'privacy' on the website homepage, must be printable, must show the date it was last updated, and must explain how the business processes opt-out preference signals (11 CCR § 7011).
  • A business that sells or shares personal information must post a clear and conspicuous homepage link titled 'Do Not Sell or Share My Personal Information' (Civ. Code § 1798.135(a)(1); 11 CCR § 7013).

What a California brokerage site must show

A California real estate licensee must disclose their name, eight-digit license identification number and the responsible broker's identity on all solicitation materials intended to be the first point of contact with consumers, and DRE regulations list websites owned, controlled or maintained by the licensee as such materials. Advertising that uses a team name must also show the responsible broker's identity as prominently and conspicuously as the team name.

What the website needs
  • Under Bus. & Prof. Code §10140.6(b)(1), a licensee must disclose their name, license identification number and the responsible broker's identity, as defined in §10015.4, on all solicitation materials intended to be the first point of contact with consumers; mortgage loan originators must also show their NMLS unique identifier.
  • Under 10 CCR §2773(a)(3), first-point-of-contact solicitation materials include websites owned, controlled and/or maintained by the soliciting real estate licensee.
  • Under 10 CCR §2773(a)(5), first-point-of-contact materials also include advertisements in electronic media, including internet, email, radio, cinema and television advertisements and the opening section of streaming video and audio.
  • Under 10 CCR §2773(a), if more than one licensee is named, each licensee's license number must be disclosed; the responsible broker's own license number is optional when the broker's name, logo or trademark appears alongside the names and license numbers of salespersons or broker associates.
  • Under 10 CCR §2773(a), in written advertising the license identification number may not be in a type size smaller than the smallest type size used in the solicitation material.

Unruh Civil Rights Act

Cal. Civ. Code § 51(b), § 51(f), § 52(a) Source

Section 51 entitles all persons, including people with disabilities, to full and equal accommodations and services in all business establishments of every kind. Section 51(f) provides that a violation of the federal ADA is also a violation of the Unruh Act. Section 52(a) makes a violator liable for actual damages and any amount set by a jury or court up to three times actual damages, but no less than $4,000 for each offense, plus attorney's fees.

What the website needs
  • Disabled Persons Act: Section 54.3(a) makes a person who denies or interferes with a person with a disability's admittance to or enjoyment of public facilities liable for actual damages and any amount up to three times actual damages, but no less than $1,000 per offense, plus attorney's fees. Section 54.3(c) bars recovering damages under both section 54.3 and section 52 for the same act or failure to act.
